Job Summary

Direct Care and Treatment (DCT) is seeking an individual to join our DCT General Counsel’s Office for an exciting and rewarding opportunity as an Associate General Counsel! This position will provide legal advice and related services primarily to DCT administration including Community Based Services (CBS), Ambulatory Care (AC), DCT Pharmacy, and DCT Medical Services. This position will also provide legal advice and related services to DCT’s Mental Health and Substance Abuse Treatment Services (MHSATS) and Forensic Services (FS) programs.

The individual in this position is responsible for providing legal advice in a variety of complex and changing areas applicable to the diverse activities of DCT divisions and facilities. Specifically, the individual provides legal advice to the DCT divisions outlined above on issues including, but not limited to, the Minnesota Commitment and Treatment Act; Minnesota Chapter 245D; data privacy and protected health information; operations at DCT facilities and residential settings; decisional capacity and due process relating to administration of neuroleptic medication and other treatment; legal review of policies; management of litigation; consultation and occasional proposed drafting for legislative matters; and matters related to facility licensing.

Primary Responsibilities:

  • Provide legal advice and related services to Community Based Services, Ambulatory Care, Pharmacy, and Medical Services leadership, management, and staff.
  • When requested by the supervisor of this position, provide legal advice and related services to program leadership, management, and staff in DCT’s Mental Health and Substance Abuse Treatment Services and Forensic Services programs.
  • Provide legal advice and services related to proposed legislative changes affecting DCT. Maintain knowledge of DCT operations and departments.
  • Coordinate claims against and litigation affecting DCT, including state and federal litigation. Perform work on other projects and responsibilities as assigned by the supervisor of this position.
  • Conduct legal review of DCT divisional policies to ensure consistency with other DCT policies, applicable statutes, rules, regulations, licensing requirements, and regulatory standards.
  • Develop and conduct trainings on legal policies.

This vacancy is posted at the Staff Attorney 1 or 2 levels. The final level will depend on the qualifications of the selected candidate.

Qualifications

Minimum Qualifications

JD degree from an ABA accredited law school;

Current license and in good standing to practice law in Minnesota;

Staff Attorney 1

One (1) year of professional legal experience in civil commitment, health care, privacy, or a related field demonstrating the experience listed below:

  • Provision of legal advice interpreting rules, laws, court orders and other legal and/or regulatory materials.
  • Knowledge of the legislative process and federal and state laws.
  • Strong legal research and oral and written communication skills.
  • Exceptional human relations skills and the ability to demonstrate effective problem analysis and creative problem-solving.
  • Experience providing legal advice to senior management or executives.

Staff Attorney 2

Three (3) years of professional legal experience in civil commitment, health care, privacy, or a related field demonstrating the experience listed below:

  • Provision of legal advice interpreting rules, laws, court orders and other legal and/or regulatory materials.
  • Knowledge of the legislative process and federal and state laws.
  • Strong legal research and oral and written communication skills.
  • Exceptional human relations skills and the ability to demonstrate effective problem analysis and creative problem-solving.
  • Experience providing legal advice to senior management or executives.

Preferred Qualifications

  • Possess knowledge of state and federal law, rules, and regulations relating to the Minnesota Commitment and Treatment Act, the Minnesota Uniform Probate Code (specifically the Minnesota Guardianship Act), the Minnesota Health Records Act, the Minnesota Vulnerable Adults Act, the Minnesota Maltreatment of Minors Act, the Health Insurance Portability and Accountability Act, and the Minnesota Government Data Practices Act.
  • Experience identifying statutes and rules that apply to individual situations and experience advising decision-makers of the legal consequences for actions or failures to act in compliance with applicable statutes and rules.
  • Experience advising on landlord-tenant issues in Minnesota.
  • Experience determining the impact of proposed or adopted changes in state or federal law, rule or regulation that impact DCT services, clients and staff.
